Principles to be Considered when Developing Best Practice Legislation for the Management of Infected Persons who Knowingly Place Others at Risk

December 2003

The report Principles to be Considered when Developing Best Practice Legislation for the Management of Infected Persons who Knowingly Place Others at Risk deals with powers to control public health risks in the event of an epidemic or where infected persons, knowingly or recklessly, place others at risk.

The report examines this difficult area of public health law, which needs to strike a balance between protection of the community and protection of individual liberty.

The report has been drafted as Part 2 of the Notifiable Diseases Project.   Part 1 being the paper on Notifiable Diseases and Notification Mechanisms, approved by AHMAC in November 2000, and also available on the NPHP Website.
